Welcome to Power Commissioning LLC. By accessing or using our website, you agree to the following terms and conditions. Please read them carefully before using our services.
1. Agreements to Terms
These Terms and Conditions (“Agreement”) govern all services provided by Power Commissioning LLC, a Florida Limited Liability Company (“Company,” “we,” “our,” or “us”), and the use of our website.
By requesting services, signing a proposal, paying a deposit, or allowing work to begin, the Customer agrees to be legally bound by these Terms.

3. Scope of Services
- Electrical service upgrades (150A–400A+)
- Panel replacements
- Generator installations (portable & standby)
- Automatic Transfer Switch (ATS) installation/replacement
- Battery backup systems (including Tesla Powerwall or equivalent)
- Load bank testing
- Commissioning & acceptance testing
- Preventative maintenance (PM)
- Protection & Control (P&C) services
- Residential & commercial wiring
- Consulting & inspections
All work is governed by the written proposal, contract, or work order issued by the Company.
4. Estimates & Change Orders
- Estimates are valid for 30 days unless otherwise stated.
- Material prices are subject to market fluctuations.
- Unforeseen conditions (hidden wiring defects, utility delays, structural damage) may require change orders.
- Additional work requires written approval.
- Verbal requests may be billed if performed.
5. Permits & Code Compliance
- Permits will be obtained when required.
- Work is performed in accordance with: NEC 2023 (or current adopted code), Florida Building Code, Local jurisdiction requirements
- Inspection scheduling is subject to government availability.
- Delays due to AHJ or utility provider are not Company liability.
6. Utility Coordination
For service upgrades or disconnects:
- Utility coordination (e.g., TECO or other provider) is required.
- Temporary power interruptions are expected.
- Scheduling is dependent on utility provider availability.
- The Company is not responsible for utility delays.
7. Payment Terms
- Deposits may be required before material procurement.
- Progress payments may apply.
- Final payment due upon completion unless otherwise stated.
- Late payments may accrue interest at the maximum rate allowed under Florida law.
- Customer agrees to pay all collection costs, including attorney fees.
8. Florida Construction Lien Notice
Under Florida law, contractors, subcontractors, and suppliers who furnish labor, services, or materials may file a lien against your property if unpaid.
By entering this Agreement, Customer acknowledges awareness of Florida lien rights.
9. Warranty
Workmanship Warranty
- Power Commissioning LLC provides a 1-year workmanship warranty unless otherwise stated.
Manufacturer Warranty
- All equipment warranties are provided by the manufacturer and subject to their terms.
Warranty excludes:
- Acts of God
- Lightning or flood damage
- Utility surges
- Customer misuse
- Lack of maintenance
- Unauthorized modifications
10. Generator & Battery System Disclaimer
- Runtime varies based on load conditions.
- Fuel supply is Customer responsibility.
- Preventive maintenance is required to maintain warranty.
- Performance depends on electrical load and installation conditions.
- The Company is not responsible for manufacturer defects.
11. Lad Bank & Commissioning Liability Limitations
For load bank testing and commissioning:
- Testing may expose pre-existing equipment deficiencies.
- Company is not liable for equipment failure resulting from latent defects.
- Customer assumes risk for aging or poorly maintained equipment.
- Testing parameters are agreed upon before execution.
12. Safety Compliance
Work is performed in accordance with:
- OSHA standards
- NFPA 70E safe work practices
- Industry best practices
Customer must provide a safe working environment.
13. Access to Property
Customer agrees to:
- Provide safe and clear access
- Secure pets
- Remove obstructions
- Ensure working space meets NEC clearance requirements
Unsafe conditions may delay work and incur additional charges.
14. Limitation of Liability
To the fullest extent permitted by Florida law:
- Company shall not be liable for indirect, incidental, or consequential damages.
- Liability is limited to the total amount paid for the specific service.
- Company is not responsible for pre-existing conditions or concealed defects.
15. Force Majeure
The Company shall not be liable for delays caused by:
- Natural disasters
- Hurricanes
- Flooding
- Government shutdowns
- Supply chain disruptions
- Labor shortages
- Utility delays
16. Insurance
Power Commissioning LLC maintains:
- General Liability Insurance
- Workers’ Compensation Insurance (or exemption if applicable)
Certificates of insurance available upon request.
17. Dispute Resolution
This Agreement is governed by Florida law.
- Any disputes shall be resolved in:
- Hillsborough County, Florida.
Customer agrees to attempt good faith resolution prior to litigation.
18. Indemnification
Customer agrees to indemnify and hold harmless Power Commissioning LLC from claims arising from:
- Unauthorized modifications
- Third-party interference
- Equipment misuse
- Failure to maintain equipment
19. Website Terms
All website content, logos, drawings, service descriptions, and designs are the intellectual property of Power Commissioning LLC.
Unauthorized reproduction is prohibited.
20. SMS & Communication Consent
By submitting contact information, Customer consents to receive:
- Appointment confirmations
- Service reminders
- Billing notifications
- Marketing messages (if opted in)
Message/data rates may apply.
21. Severability
If any provision is found unenforceable, remaining provisions remain valid.
22. Entire Agreement
This document, together with signed proposals or contracts, constitutes the entire agreement between the parties.
